Terms of Service

1. Acceptance of terms
By using ViralMint ("the Software"), you agree to these Terms of Service. If you do not agree, do not use the Software.
2. Description of service
ViralMint is a desktop application for content creators that provides video scouting, analysis, clipping and generation tools. The Software runs locally on your computer and optionally connects to our cloud services for AI features. ViralMint does not publish or upload to any platform on your behalf: you download the finished files and post them yourself.
3. License
The ViralMint desktop application is released under the GNU Affero General Public License v3.0 (AGPL-3.0). The source code is available at github.com/openclaw-easy/ViralMint, and the definitive license terms are specified in the LICENSE file in that repository.
4. User responsibilities
You are responsible for:
- Content compliance — ensuring that content you create, download and post complies with applicable laws and platform terms of service
- Copyright — respecting copyright and intellectual property rights when downloading and analyzing competitor videos
- Platform terms — complying with YouTube, TikTok, and other platform terms when downloading from or posting to them
- Account security — keeping your ViralMint account credentials and the device you sign in on secure. ViralMint holds no provider API keys on your behalf and you cannot bring your own; all AI access runs through your ViralMint account.
5. Acceptable use
You agree not to use ViralMint to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Create or distribute harmful, misleading, or deceptive content
- Circumvent platform rate limits or access restrictions in a way that violates platform terms
- Distribute malware or engage in unauthorized access to systems
- Harass, abuse, or harm others
6. Cloud services (optional)
If you create a ViralMint account to access cloud features (AI chat, AI image / voice / music generation, channel sync):
- Daily starter allowance — a small daily allowance refills automatically each day, up to a fixed cap, so new accounts can evaluate the AI features before topping up. No payment method required to use it. The allowance is provided at our discretion and may be reduced or removed at any time.
- Prepaid top-ups — for usage beyond the daily allowance, you can add to a prepaid USD balance via one-time Stripe payments. There are no subscriptions, no recurring billing, no auto-renewal. Each billable action deducts from the balance at the rates published on our pricing table.
- Daily spend cap — every account has a per-day spend cap (default $30/day) as a safety limit against compromised tokens. Configurable per user.
- Refunds — prepaid balance is non-refundable except where required by law. We do honor refunds when our cloud incorrectly charged you (e.g. duplicate billing, failed generation that wasn't auto-refunded) — contact support@viralmint.net.
7. Third-party services
ViralMint integrates with third-party services (AI providers, video platforms, payment processors). Your use of these services is governed by their respective terms and policies. We are not responsible for third-party service availability, pricing changes, or policy changes.
8. Intellectual property
Content you create using ViralMint belongs to you. The ViralMint name, logo, and branding are trademarks of ViralMint. The software source code is licensed under AGPL-3.0 — see Section 3 for details.
9. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
10. Limitation of liability
To the maximum extent permitted by law, ViralMint and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or revenue, arising from your use of the Software.
11. Changes to terms
We may update these terms from time to time. Continued use of the Software after changes constitutes acceptance of the updated terms.
12. Governing law
These terms are governed by the law of the jurisdiction in which the operator of ViralMint resides. Any dispute shall be brought in the courts of that jurisdiction, unless consumer-protection law in your country gives you the right to bring it where you live.
